With the Captains suffering casualties and heavy injuries on their side, all hope seemed to be lost... until Shinji Hirako appeared, along with the rest of the former Shinigami. Though the aid of the Vizards certainly helped to draw the battle in their favor, it seemed Aizen's power alone proved too much for them.
As Hitsugaya was passing the commanders general headquarters, he comes across some guards outside which would never be there unless something was going on so he pauses for a moment and begins to walk up to the guards, as they see him coming they lose their nerve a but remain there posture, he then says to them.
“What is going on here I didn’t expect the commander to be in must be something of importance, so is someone going to give me reason, * one of the guards begins to speak saying “ Uh Captain Hitsugaya the Trial of Tommyco Third seat of second division, he attacked a fellow division member, Hitsugaya sighs and says back to them,
“Well stand aside anyone that attacked a fellow soul reapers deserves to stand trial. With that Hitsugaya walks in and slides the doors to walk in seeing the commander plus some others, so not to intrude he walks in and silently stands beside Unohana knowing that she Trusts him and would not mind him being there.
Daigoro grimaced, and walked into the room. He shook his head. "Fine. Seeing as nobody else is going to talk, I will." He began to recount the events of the previous night. "I'll admit, I only walked in at about... Tommyco mentioning his plight for the vice-captaincy. That's when the fighting began. I stopped them, treatening them both with death. That's when Tommyco became really violent. He grabbed me, punched me in the face and made insulting comments about my seal." Daigoro looked back up. "That was when I left. But that was not the only reason I spoke up here. I wish to apply for a re-seating of the second division, and place my vote for Sayuri Sasaki to be promoted to third seat..."
Tommyco looked at Captain Hitsugaya as he walked into the room." Hello captain Hitsugaya." Tommyco thinks to him self why would he be here any way. He then got back to what the others was saying.
Tommyco yelled "I did not do any of that!! I was upset when I hit the 4th seat and I said sorry to him. In the past I did not do anything to disrespect any boy of 2nd division. But head captain I will take what ever punishment you see fit. Even if I think this should not be happening to me anyway."
Tommyco looked at the others who came to help him and said "plz let the others go, just let me take the punishment." Tommyco then took a good long look at Soifon. " Captain I would understand If you would like for me to be kicked out of 2nd division. punishment I will take the punishment now then because I understand you would not take my word over theres anyway so what is there for me to do." He smiled at the head captain.
"Tommyco then said yes I think Sayuri should take my place. Can I also ask if captain Soi Fon will not keep me as a member of her division, Can I be moved to 7,9, or 10th division. But anyway I am ready for this punishment."

Unohana listened to the rest of the stories, then turned to Tommyco as he spoke, "Tommyco... I do not wish to believe you're lying to me... you're not lying to me, are you?"
There was a pause as if time skipped a beat, then a sudden, hellish, monstrous tension that struck fear in everyone in the room, right up to Soifon herself. It was like an ocean of pressure fell into the room just as Unohana smiled a little more at Tommyco. Her smile never showed teeth, and she had those closed, happy eyes, yet... god there was SOMETHING WRONG!! Monstrous... Dark... Evil... WRONG! Yet motherly, sweet, nice, and right!
Yes, Unohana used her infamous death gaze, and spoke out words that could crack anyone in existence, "You're not going to lie to me... right... Tommyco?" she said with a tone that hinted at insisting. It was like staring into the void as she said those words. As if this motherly woman was a literal goddess that could do what ever the hell she wanted and get away with it. An overwhelming sense of do as she says, or she'll tear your soul right out of your body like a fruit off a tree branch, and make you cry like a baby as she messed you up scary style. Yet on the outside, she simply had that soft smile, and those smiling eyes that made her seem like a loving mother.
All in all? Unohana was not someone you wanted to make mad. Never in a billion years. If you misbehaved beyond this point the it felt like the wrath of the universe would simply fold in on one person like a sun imploding on itself.
Soifon's eyes widened a little, and she grimaced as her arms fell to her sides a bit. She'd never before witnessed Unohana do this before, and it scared her senseless! She even lost a little color in her face. By god, if Tommyco didn't shape up, she was certain he'd be in a worse hell than Soifon could cook up. So... amazed at Unohana's presence at this moment she forgot to be angry at Tommyco being a goddamn moron in lying to Unohana.
Karel stood quietly outside the room, his back against the wall as he listened to the conversation being held within. There was no need to announce his arrival, Unohana-taichou already knew he was there, even before he started listening in. He had only been her about as long as Hitsuguya, but Karel had already heard enough to understand just what was taking place here. Tommyco had committed a crime, he had threatened one of his comrades, and he had lied to Unohana herself. Now Karel was not a pure man by any means. He had killed before, many people, he had killed his own Captain (albeit a duel) over a hundred years ago. But lying to Unohana? No, that was something he would never do, no matter how "insane" he was, he wouldn't dare face Unohana. Karel continued to lean against the wooden wall outside the room where the trial was held, his paperwork was caught up, he had nothing better to do than standby if necessary.
Tommyco had much fear in his heart as the head captain was talking to him. When she talked it was like she was playing a mind game with him. How could sombody so kind and sweet, strike fear into him with one look.
Tommyco then looked up and said "I am lying about some of it I am truly sorry about what I have been doing. I will take any punishment you can throw at me peacefully and with honour."
Hitsugaya watched as the commander became some demon, he only ever seen her like this once but to be this close to her, was scary he then looks to Tommyco and says to him.
“You know is people like you that make people despise us, what gave you the right to do what you did, whatever you do reflects on the rest off and there are many people around that want to see you face your crimes, I have some small respect for you as in your going to accept whatever punishment the commander sets you.
But if I had my way I would have exiled or even killed but that is not my call to make, im sorry Captain Soi but I dislike people like tommyco who think they can break the rules, *at this point Hitsugaya was letting of a small amount of Sprit power not enough to worry but enough to know he means what he says he then carries on speaking saying.
“From this day fourth and till I deem you worthy to stand with us you are banned from coming anywhere near my divisions headquarters unless it is for official duties, but you lost all respect with me tommyco, he then goes back to standing next to the commander

(For the sake of brevity)
Unohana took a light breath, then sipped her tea as Tommyco confessed to lying. She made no hint of what she thought of it as she maintained that poker face, and the tension in the room went from stifling to when the group first entered.
She listened to Toshiro's spirited speech, and declaration, "Well stated Captain Hitsugaya," she said softly to him.
She spent a moment in silent contemplation as she added the fact that he lied to her, and treated her like a moron in attempting to pass only a sliver of truth by her when there was so much more he attempted to cover up. Of course she saw through his initial lie, and the attempt to dodge full responsibility made just now.
Unohana spoke softly, "Tommyco is to spend one week in the nest of Maggots to understand just what lies ahead of him should his reckless behavior continue. Another two weeks will be spent cleaning the Seireitei from one side of the complex to the other as a janitor," she said without hesitation. "He will work double shifts at the barracks of Squad 11," she added softly as if she wished to cause said squad no embarrassment, but, honestly, they lived like bachelors there, and it was the least glorious dorm.
"For those three weeks, Tommyco's Zanpakuto is forbidden from his use unless he receives a captain's permission immediately, or if his life is about to be ended... any diversion from this will result in his Zanpakuto being stripped from him permanently, and exile from the Gotei 13."
"Furthermore," she began, apparently not done punishing him, "Tommyco shall be stripped of all rank, and will never hold a seat in any of the Gotei 13 court guard squads until Captain Soifon, or who ever is his captain in the future says otherwise."
"Any desire to be transferred to another squad will have to be taken up with Captain Soifon, but in asking, Tommyco will have no say in where he is sent," she spoke then took a sip of tea to keep her throat moist, then resumed her unreadable facial expression.
"Now, that leaves Tommyco's cohorts who will not escape punishment..." she began once more, and her expression changed to be less cheerful as she spoke, "As they had no excuse for their actions short of divided loyalties which caused them to rebel against Captain Soifon, they are to be executed on Sokyoku Hill in the morning. Any attempt to escape this fate will have Tommyco sharing their fate," she said with a peaceful finality.
"The conspirators, including those who survived the escape attempt, will be executed by volunteers made up by seated officers and they will be allowed to use what ever means as they see fit to perform the execution. Tommyco will be there to witness the price of bald faced treachery against the Gotei 13," she gave her decree with an eerie calm. She didn't sound as joyful as she spoke.
It never showed, but deep down she knew that this would shock everyone to the core, but that decree was the law, and not her choice. She did not want to be harsh, but it was a necessary evil.
"Are my edicts understood?" she turned her soft gaze towards the group assembled.
"Yes, Captain Commander Retsu," Soifon knelt down respectfully. Soifon seemed to cheer up as she heard the decree, then cast a glance at one of Tommyco's gang members as if she were picked one for herself to be slaughtered.
In all honesty Yukino was bored and tired. It was early in the morning when the party had started, after that she had to deal with Tommyco, then she had to fight him, and now she had to hear his punishment. Yukino definatly couldn't care less about the fate of Tommyco, so she didnt see any reason why she whould have been here in the first place. Either way, the punishment was almost over, and Yukino could go back to the dorm and day dream or sleep the day away. Yukino would have been happy that Hitsugaya-taichou was here, but she was so caught up in all of this drama that she was only focused on one thing, Unohana-sama.
Unohana stated the punishment of Tommyco and his little gang members. Tommyco would be forbidden from using his zanpakutou for a period of time, he'd spend two weaks at the maggots nest, and he will be stripped of all ranks unless Soifon-taichou had a sudden change of mind. Which she probably wouldn't. Everyone seemed to be shocked my the punishment, and Unohana's creepy personality, all except Yukino.
Unohana's voice went in one of Yukinos ears, and left through the other. Yukino thaugh that the punishment Tommyco and his gang recieved was acceptable and that Unohana's poker face could be seen right through. Yukino knew not to mess with her, and unless she was in Tommyco's spot, her chilly ways wouldn't get to her.
"Are my edicts understood?" Unohana said in that same ol' voice. '' Hai Unohana-sama '' Yukino said in a cold and emotionless tone, her vpice wasn't as loud as Soifons but Unohana could prbably hear it. Being formal and professional, Yukino bowed, and the shut her mouth.
Sayuri stood silently the entire each spoke their peace, though like many in the room at the time - she felt an eerie, fearful chill run up her spine when Unohana questioned Tommyco when he blatantly lied to her. Why the fool would make such the poor decision as to lie to Unohana's face was beyond Sayuri's comprehension at this point, his level of stupid was just too much for her to try to understand, not that she tried too hard, though.
When listening to Unohana's decree, she naturally remained silent and listened carefully. Once she questioned those present if they understood her judgment, Sayuri like her Captain dropped to one knee while bowing her head, "Yes, Captain-Commander.", she answered with her natural quiet tone of voice.
